This Privacy Policy and Cookie Policy (this “Policy”) explains how Valley Mechanical LLC, doing business as Valley Air Conditioning & Heating, LLC (“Valley,” “we,” “us,” or “our”), collects, uses, discloses, and protects information about you when you visit https://www.valley-air.com (the “Site”), call us, or otherwise interact with us.

Valley is a licensed air conditioning and heating (HVAC) contractor serving Simsbury, CT, and Hartford and Litchfield Counties. Our principal place of business is located at 129 West St, Simsbury, CT 06070.

Please read this Policy carefully. By using the Site, submitting a form, or calling a telephone number displayed on the Site, you acknowledge that you have read this Policy. Where required by law, we will obtain your consent before we place non-essential cookies, share your information for targeted advertising, or record a telephone call, as described below.

1. Information We Collect

We collect the following categories of information:

Information you provide directly. When you submit a contact or quote form, schedule service, subscribe to communications, or otherwise contact us, you may provide:

• Your name;
• Home or business address;
• Email address;
• Telephone number;
• A description of your service needs, equipment, or project; and
• Any other information you choose to include in your message.

Information we collect automatically. When you visit the Site, we and our service providers automatically collect certain information through cookies, pixels, software development kits (SDKs), and similar technologies, including:

• Your IP address and general (city/region-level) geographic location;
• Browser type, language, operating system, and device type;
• Pages viewed, links clicked, time spent on the Site, and scrolling or mouse activity;
• The website or advertisement that referred you to the Site; and
• Unique identifiers assigned to your browser or device by our analytics and advertising partners.

Information collected when you call us. When you call a telephone number displayed on the Site, our call-analytics provider (Invoca) and we may collect your telephone number, the date, time, and duration of the call, the marketing source that generated the call, your general location, and — where you have been notified and, where required, have consented — a recording or transcription of the call. See Section 5.

Information from third-party tools. Our Site uses third-party analytics and advertising tools that collect information about your activity on the Site and, in some cases, across other websites and apps. These currently include Google Analytics (with Google Signals), Google Ads, Google Tag Manager, Meta (Facebook) Pixel and Facebook Custom Audiences, and Invoca. See Section 4 for details about each.

We do not intentionally collect Social Security numbers, financial account or payment card numbers, precise geolocation, health information, or other “sensitive data” through the Site. Please do not submit sensitive information through our web forms.

2. How We Use Your Information

We use the information we collect to:

• Respond to your inquiries, quote requests, and service requests;
• Schedule, coordinate, and follow up on service appointments;
• Send you information about our services, promotions, and company updates where you have consented or where otherwise permitted by law;
• Operate, maintain, secure, and improve the Site and understand how visitors use it;
• Measure, and where you have consented, deliver, advertising and remarketing campaigns, including matching your activity to advertising audiences; and
• Comply with applicable laws and enforce our agreements.

We will not process your personal data for a materially new purpose that is not reasonably compatible with the purposes described here without first providing notice and, where required, obtaining your consent.

3. How We Disclose Your Information

We disclose personal data in the following ways:

• Service providers (processors). We share information with vendors that perform services for us — such as our website host, form and scheduling tools, email and CRM providers, and analytics providers — who are permitted to use the information only to provide services to us.
• Advertising and analytics partners. We enable Google, Meta (Facebook), and Invoca to receive information about your interaction with the Site so that we can measure and deliver advertising. Depending on how these tools are configured, this disclosure may be treated as “targeted advertising” or a “sale” or “sharing” of personal data under applicable state law, even though no money is exchanged. You can opt out — see Section 8 (“Your Privacy Choices”).
• Legal and safety. We may disclose information to comply with law, legal process, or a government request, or to protect the rights, property, or safety of Valley, our customers, or others.
• Business transfers. If Valley is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.

We do not sell personal data to data brokers for their own independent marketing.

4. Cookies and Tracking Technologies (Cookie Policy)

Cookies are small text files stored on your browser or device. We also use pixels, tags, and similar technologies. We use the following categories:

Consent management. When you first visit the Site, you will see a cookie consent banner that lets you accept or decline each category of non-essential cookie. Non-essential cookies (Functional, Analytics, and Marketing/Advertising) are not loaded until you affirmatively accept them. You can change your choices at any time using the “Cookie Preferences” link in the Site footer.

The specific third-party tools we use are:

• Google Analytics with Google Signals. Google Analytics measures how visitors use the Site. With Google Signals enabled, Google associates this activity with signed-in Google users who have turned on Ads Personalization, which allows cross-device reporting and remarketing audiences. This involves Google’s use of your data across sites and services. You can control this through your Google Ads Settings, opt out of Google Analytics via the Google Analytics opt-out browser add-on, and review how Google uses data from sites that use its services.
• Google Ads and Google Tag Manager. Used to deliver and measure our advertising and to manage tags on the Site. Controls are available through your Google Ads Settings (above).
• Meta (Facebook) Pixel and Facebook Custom Audiences. The Meta Pixel reports your activity on the Site to Meta so that we can measure our advertising and build Custom Audiences to show you and similar users our ads on Facebook, Instagram, and the Meta network. You can manage these ads through your Meta Ad Preferences and the Meta advertising help page.
• Invoca (call analytics). When you call a number on the Site, Invoca captures call and marketing-attribution data and may record or transcribe the call as described in Section 5.

Industry opt-out tools. You can also opt out of interest-based advertising from participating companies through the Digital Advertising Alliance, the Network Advertising Initiative, and (for EU/UK users) Your Online Choices.

Universal opt-out / Global Privacy Control. We recognize the Global Privacy Control (GPC) and other universal opt-out preference signals. If your browser or a browser extension sends a GPC signal, we treat it as a valid request to opt out of targeted advertising and the sale or sharing of personal data for the browser and device from which it is sent. See the Global Privacy Control site for more information.

Do Not Track. Because there is no common industry standard for “Do Not Track” browser signals, the Site does not respond to them; we do, however, honor GPC as described above.

5. Call Recording and Monitoring Notice

We use Invoca to understand which of our marketing efforts generate calls and to improve customer service. Calls to telephone numbers displayed on the Site may be monitored, recorded, or transcribed for quality, training, marketing-attribution, and record-keeping purposes.

We will notify you at the start of a call if it may be recorded. If you do not consent to being recorded, please tell the representative or end the call and contact us by another method. By continuing with a call after this notice, you consent to the recording, monitoring, and transcription of that call by Valley and its service provider.

6. Your Consent to Site Tracking and Advertising

Advertising and analytics tools like Google Analytics with Signals, the Meta Pixel and Facebook Custom Audiences, and Invoca operate by transmitting information about your visit to those third parties, who may use it for their own purposes. We do not enable these non-essential tools until you have been given notice of them in this Policy and have provided consent — through the cookie consent banner and, for form submissions, by submitting a form that displays the acknowledgment described below.

Where we collect information through a form (for example, a quote or scheduling form), the form displays a clear notice, positioned next to the submit button, substantially as follows:

By submitting this form, I agree to Valley’s Terms of Use and acknowledge Valley’s Privacy Policy, including the use of cookies, analytics, advertising tools, and call recording described in it.

This notice, and your act of submitting the form, are intended to give your informed consent to the collection, use, disclosure, and recording practices described in this Policy.

7. Your Privacy Rights (Connecticut Residents)

If you are a Connecticut resident, the Connecticut Data Privacy Act gives you the right to:

• Confirm and access whether we process your personal data and obtain a copy of it, including any inferences and whether it is used for profiling;
• Correct inaccuracies in your personal data;
• Delete personal data we have collected from or about you;
• Obtain a portable copy of the personal data you provided, in a readily usable format, where processing is automated;
• Opt out of the processing of your personal data for (a) targeted advertising, (b) the sale of personal data, and (c) profiling in furtherance of decisions that produce legal or similarly significant effects; and
• Obtain a list of the third parties to which we have disclosed personal data.

How to exercise your rights. Submit a request through our “Your Privacy Choices” page, by email to service@valley-air.com, or by calling 860 658 0371. We will not discriminate against you for exercising your rights. We may need to verify your identity before responding. You may use an authorized agent to submit a request on your behalf, subject to verification.

Our response. We will respond within 45 days. We may extend that period by an additional 45 days when reasonably necessary, and will tell you if we do.

Right to appeal. If we decline to act on your request, we will explain why and how to appeal. To appeal, contact us at service@valley-air.com. We will respond to an appeal within 60 days. If we deny your appeal, you may submit a complaint to the Connecticut Attorney General.

8. Your Privacy Choices — Do Not Sell or Share My Personal Information

You can opt out of targeted advertising and the sale or sharing of your personal data — including the sharing described in Sections 3 and 4 with Google and Meta — in any of these ways:

• Use our opt-out link. Click “Your Privacy Choices” / “Do Not Sell or Share My Personal Information” in the Site footer to submit an opt-out request.
• Set your cookie preferences. Use the “Cookie Preferences” link to decline Analytics and Marketing/Advertising cookies.
• Send a universal opt-out signal. Enable Global Privacy Control in your browser; we honor it automatically as an opt-out for that browser and device.
• Contact us. Email service@valley-air.com or call 860 658 0371.

Because an opt-out preference signal and cookie choices are specific to the browser or device you use, you will need to opt out on each browser and device.

9. Residents of California and Other States

If you are a resident of California or another state with a comprehensive privacy law, you may have rights similar to those described in Section 7, including the right to know, delete, correct, and opt out of the sale or sharing of your personal data and, where applicable, to limit the use of sensitive personal information. You may exercise these rights using the methods in Sections 7 and 8. California residents interacting with the Site are also subject to the tracking and call-recording notices and consent mechanisms described in Sections 4, 5, and 6.

10. Sensitive Data

We do not process sensitive data (as defined by applicable law) through the Site without your consent, and we do not sell sensitive data. Please do not submit sensitive information through our forms.

11. Data Retention

We retain personal data only for as long as necessary to fulfill the purposes described in this Policy and to comply with our legal, tax, and contractor-licensing obligations.

12. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

13. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal data from children. We do not process the personal data of a consumer we know to be at least 13 but under 18 for targeted advertising or sale. If you believe we have collected information from a child, please contact us and we will delete it.

14. Third-Party Links

The Site may link to third-party websites we do not control. We are not responsible for their privacy practices, and we encourage you to review their policies.

15. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the “Last Updated” date above. Material changes will be posted on the Site. Your continued use of the Site after an update constitutes acceptance of the revised Policy to the extent permitted by law.
